Prior to beginning work on this interactive assignment, please read all of the required resources for this week. For this week’s interactive assignment, you will be creating a 5-7 minute video speech presentation related to the topic of cyberbullying. For your video presentation, prepare talking points that respond to each of the following topics.

Explain at least one of the basic legal rights of individuals who are impacted by cyberbullying.
Discuss one technique individuals, parents, or businesses can use to protect themselves or their children from cyberbullying.
Evaluate at least one ethical issue that parents, schools, or workplaces must consider when implementing a new technique to protect their children, students, and/or staff from cyber bullies.
Once you have created your talking points, be sure to practice your presentation to ensure that it will meet the time requirements. Please review the Best Practices for Video Creation document prior recording your video.

Australian Visa System- Economic Migration

1. Can it be said that the European Court of Human Rights and the European
Committee for the Prevention of Torture  have a relationship that is mutually-beneficial insofar as each standard-setting organ has been aware of the other’s expectations and in turn has built upon these in its own task of discharging its treaty mandate?

2. ‘One of the most powerful themes in the case law of the European Court of
Human Rights is the protection against arbitrary application of the law.’ Explain
and critically assess the nature and scope of this protection.

6. Answer ONE of the following questions based upon domestic law and practice
concerning human rights, drawing upon any European standards to help your analysis of the topic.
a. Is the way that Scotland treats its most vulnerable children and young people who are placed in detention a hidden scandal that society simply tolerates? if so, is this an area that the legal system and human rights lawyers in particular can remedy?

b. How should the law deal with the problem of hate speech and other displays of intolerance?

c. Post-Brexit, how can the UK best protect its borders in a human rights-compliant manner?

d. ‘The recent suggestion from the UK Minister of Justice and others that reform of the Human Rights Act should extend to requiring the courts to give more prominence to freedom of expression in any case calling for balancing free speech with Article 8 rights. This is simply more of the same from right-of-centre Governments – an unwillingness to recognise that protection for human dignity in relation to private life is as important an interest as is democracy as evidenced by systemic undermining of respect for private life through domestic law and policy.’ Discuss.
e. Discuss the contention that female detainees in this country area ‘forgotten
category’ of prisoner. How can human rights standard-setting address the specific needs of this group?

Mental Health Law and Policy

Alan is 80 years old and has suffered from Vascular Dementia for the last 10 years. As a result of his condition Alan is very confused and needs supervision to make sure that he does not hurt himself or wander from the house and place himself in danger.
Alan currently lives with his wife, Jacinta, who provides most of his care. Some additional care is provided by Local Authority carers who come to the house once a day to give Jacinta some respite. Recently, however, Jacinta fell and broke her hip and has, therefore, been unable to care for Alan. Alan and Jacinta’s daughter, Alex, moved into her parents’ house on a temporary basis to take care of both her parents while Jacinta recovered.
Alex and the Local Authority carers are concerned about whether Jacinta will be able to provide adequate care for Alan when she recovers. Discussions have, therefore, taken place about Alan moving into a Local Authority care home. Alex and the Local Authority carers think that this is the best course of action, but neither Alan nor Jacinta want this to happen.

What would be reasonable grounds for bail, and would Sophia be successful in obtaining this?

Civil and criminal litigation problem question.

Sophia is a 25-year-old full time student studying Business at South West University. Sophia lives at home with her mother and has recently decided to leave her part time job to focus solely on her final year of studies. She has no health issues, no dependents and has no previous criminal convictions to date.

On Monday 1st April at 10pm Sophia visited her local supermarket to purchase some food and take a break from studying, which she had been doing for the last 5 hours. Whilst exiting the store, Sophia was stopped by security and asked to show her receipt and the items which she had purchased. During the inspection a total of five items out of nine were not scanned (via the self-service checkout) which amounted to a total of £57.56 of unpaid items. The police were called to the supermarket and Sophia was arrested for Theft, detained and taken to Stratford Police station for questioning.

Sophia has asked for a duty solicitor to be provided, which has now been passed onto you to carry out proceedings on behalf on your law firm which you are employed as a criminal solicitor for.

You arrive at Stratford Police Station at 12.30am on Tuesday 2nd April and have an initial meeting with Sophia. She has explained that she has been very tired due to studying and adamant she did scan all nine items at the self-service check out and this must be a computer error. CCTV will be provided by the supermarket in due course to review.

Sophia has asked whether you can explain her rights, when she can be released, the next steps in the case and what are the options if she pleads guilty or not guilty in her interview with the police.

Advise Sophia in relation to:
Her rights whilst in custody at Stratford Police station .

Migration Interview Report
OVERVIEW
For this assessment you will interview a person who has migrated, asking them about their experience after migrating. It is important you maintain confidentiality – see notes under ‘confidentiality’ below.
You will write a report and there is one main question you must respond to :
•(q1) How did your interviewee’s identities shape their experience of migrating?
but in answering this you need to spend a small number of works introducing the
participant by responding to the following:
• What is the broad context in which the person you interview migrated
and finally respond to the following question:
(q3) Can the concept of othering, as used in the Leitner article, be used to
explain the experience of the person you interviewed?
You will submit two document (1) the report/essay (2) the transcript of the interview
Use the following ‘data’ sources:

-a comparison with the experience of your group members (this is essential)

how to do this:
(1) Conduct and then transcribe the interview. The transcription is where you write
down, word-for-word, what was said in the interview. This needs to be at the very least 800 words but might be a lot more than this. You can try using an online transcription site to help with the transcription if you want, for example: otter.ai The transcription needs to be submitted with the report.
(2) Analyse you interview.
