Did the sale of an item via eBay provide sufficient minimum contacts to support personal jurisdiction over a nonresident defendant in the buyer’s forum state?

FACTUAL BACKGROUND AND PROCEDURAL HISTORY

Boschetto’s request for additional discovery relevant to jurisdiction was similarly denied by the district court. The court held that Boschetto’s request for extra discovery was based on “speculation] without any support” that the additional discovery would provide jurisdictionally relevant facts, notwithstanding its “wide discretion” to allow or refuse such discovery. Id. On July 17, 2006, a judgment was entered, and this timely appeal was filed.

Did the sale of an item via eBay provide sufficient minimum contacts to support personal jurisdiction over a nonresident defendant in the buyer’s forum state?

2) Proper Citations (ie. did you correctly use Bluebook and correctly use the citations and not rely overly on quoted material?) worth 25 points;

3) Correctness of the Information Conveyed (ie. do you correctly explain the law and facts and correctly draw conclusions?) worth 25 points; and

4) Writing Quality (ie. is the paper well organized with opening and closing paragraphs, point sentences, lacking typos and grammatical errors, within page parameters?) worth 25 points.

How is the facility constructed?Linear,or pods,or dormitories?Does the facility utilize direct or indirect supervision?

Internship

If you are interning with a secure detention facility such as a jail or a prison, your paper might include some of the following:

What populations does the facility detain?

Is it a federal, state, or local institution?

Do they hold adults or juveniles?

How big is the facility?

What is the jurisdiction? Do they hold inmates from other jurisdictions?

How is the facility constructed?Linear,or pods,or dormitories?Does the facility utilize direct or indirect supervision?

Have the inmates all been convicted of a crime, or are there inmates awaiting trial? Does the facility hold some other population, such as undocumented migrants?

Are there any treatment programs in the facility? Job training? Substance abuse? Mental health services?

How are health care services provided?

How are the other daily needs of the inmates met? Food? Hygiene? Laundry? Religious services?

Are there different wings or sections for different populations? For example, men and women must be housed separately.  But what about other groups? Veterans? Gang members? Mentally ill inmates? Other groups?

Is there a structured daily routine? If so, what is it?

How are entry level staff recruited and trained?

On what basis are entry level staff evaluated and/or promoted?

If you are interning with a community corrections program, you could discuss the following:

Is it a federal, state, or local agency? Adult or juvenile?

What is the jurisdiction of the agency?

How are the probationers or parolees assigned to the agency?  In other words, when a defendant goes to court for a charge, is tried, convicted, and sentenced to probation, what happens next?

How big is the agency? How many probation or parole officers are there in the office?

How many probationers or parolees does the agency supervise? What is the average caseload for a probation or parole officer?

What are some of the more common charges offenders on supervision are convicted of?

How are cases divided up between the officers?  Geographically? By type of offender (drug offender, sex offender, etc)?

Evenly, so all officers have the same size caseload?

How often do probation or parole officers make contact with their clients? Are there levels of supervision that require more or fewer contacts?

Is there an intensive supervision program?

What do the probation or parole officers do to supervise their caseload?  Home visits? Drug tests? Job counseling?

Electronic monitoring? What circumstances justify the use of these interventions?

How are entry level staff members recruited and trained?

On what basis are staff members evaluated and/or promoted?

Does your analysis indicate any potential problems with the fairness of this process? How and why?

Alternative dispute resolution mechanism arbitration

Write a short (3-4 page, double-spaced, 12 point font) paper regarding whether the alternative dispute resolution mechanism arbitration meets basic due process requirements. Apply the due process factors set forth in Chapter 3 to AT&T Wireless’s arbitration clause, which states in part:

“Most customer concerns can be resolved quickly and to the customer’s satisfaction by calling our customer service department at 1-800-331-0500. In the unlikely event that AT&T’s customer service department is unable to resolve a complaint you may have to your satisfaction (or if AT&T has not been able to resolve a dispute it has with you after attempting to do so informally), we each agree to resolve those disputes through binding arbitration or small claims court instead of in courts of general jurisdiction. Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, allows for more limited discovery than in court, and is subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. Any arbitration under this Agreement will take place on an individual basis; class arbitrations and class actions are not permitted. For any non-frivolous claim that does not exceed $75,000, AT&T will pay all costs of the arbitration. Moreover, in arbitration you are entitled to recover attorneys’ fees from AT&T to at least the same extent as you would be in court.”

For your essay, you’ll need to define “alternative dispute resolution,” “arbitration,” and “due process.” Does your analysis indicate any potential problems with the fairness of this process? How and why?Why would AT&T want such a clause? Is this fair to AT&T’s customers? Why?

What are the causes and effects of domestic violence, and the intervention programs used to combat it?

Outline of Literature Review Update

Literature Review Outline

Introduction

The title of this study is “The Effects of Domestic Violence on Women”. Domestic violence refers to abuse or violence done in a domestic setting, such as cohabitation or marriage (Akhmedshina 2020). Some types of violence include physical assault, marital rape, and sexual abuse (Naz et al., 2018). The instances of domestic violence have records of negative effects on women, including unwanted pregnancies, death, mental health problems, and physical injuries (Sharma et al., 2019; Tavoli et al., 2016). However, there are interventions to deal with domestic violence on women (Bellini et al., 2020).

What are the causes and effects of domestic violence, and the intervention programs used to combat it?

Academic databases were searched to discover relevant research articles about domestic violence’s impact on women, its causes, effects, and developed interventions.

Despite affecting women (victims), domestic violence also affects the doer and children, especially when it is in a marriage setting.
Body

Effects of Domestic Violence

The articles have discussed numerous effects of domestic violence. Also, they have information on the adverse effects of violence on women’s mental and physical health (Kharé 2018). Idhris et al. (2018) have shared the health effects and work effects, stating that additional effective interventions are required to minimize sexual assault on women.

Interventions on Domestic Violence

The articles have a similarity since they have shared information on the need to introduce effective interventions to solve this issue.

What are the intervention programs used to combat domestic violence?

Purpose of the Study

Through this study, I hope to understand the effects of domestic violence on women. Furthermore, will explore the various intervention programs created to help women overcome the negative impacts of domestic violence.

Corporate law should be changed to prohibit management from using most of the legal methods currently used to fight takeover?

Debate This: Takeovers

Read the following case then debate #1:

Mario Bonsetti and Rico Sanchez incorporated Gnarly Vulcan Gear, Inc. (GVG), to manufacture windsurfing equipment. Bonsetti owned 60 percent of the corporation’s stock, and Sanchez owned 40 percent. Both men served on the board of directors. Hula Boards, Inc., owned solely by Mai Jin Li, made a public offer to buy GVG stock. Hula offered 30 percent more than the market price per share for the stock, and Bonsetti and Sanchez each sold 20 percent of their stock to Hula. Jin Li became the third member of the GVG board of directors. An irreconcilable dispute soon arose between Bonsetti and Sanchez over design modifications of their popular Baked Chameleon board. Despite Bonsetti’s dissent, Sanchez and Jin Li voted to merge GVG with Hula Boards under the latter name, Gnarly Vulcan Gear was dissolved, and production of the Baked Chameleon ceased.

Debate the following: Corporate law should be changed to prohibit management from using most of the legal methods currently used to fight takeover?
