Assignment: Select one major United States Supreme Court criminal case which you find most interesting. The case you select should also reflect one you can adequately analyze in this essay, so read the parameters of the essay first. The case may NOT be from the Capstone Courses discussed in Complete exercises but may come from your textbook readings. The essay is not designed to simply be a case briefing, although these are helpful and may be used for portions of your essay. For example, if a student chooses Miranda v Arizona, whereas the precedent requires anyone in custodial interrogation be advised of their due process rights, then the student will need to investigate further the actual state law violated, and in which state it happened, and the events leading up to the appeal. Research and scholarly journal articles are expected to ground the essay with a solid and scholarly foundation.

Conceptualization of What Constitutes a Hate Crime

Overview:
The purpose of this assignment is to provide you with an opportunity to think about hate crimes by trying to conceptualize what is meant by the term and whether or not definitions of hate crime should or should not include select provisions (e.g., race, sexual orientation, gender, disability, celebrity, political affiliation, etc.).

Requirements:
Find a recent hate crime case (from January 2015 until the present) in a reputable newspaper (New York Times, LA Times, Chicago Tribune, etc.) and link the article in the Works Cited of your paper. This case must be from the United States and must have ended: plea bargain, guilty verdict, found innocent, etc. No papers about cases without verdict, for example: Charlottesville.Using the case you’ve found, consider the ideas and examples presented in class. Having considered this material (lecture and readings), summarize the case (max. 1-page summary) and then answer the following types of questions in an essay format:

Defense attorneys encounter ethical issues that arise in the areas of responsibility to the client (they must defend clients even if they believe they might be guilty), conflicts of interest (balancing an individual client against overall effectiveness as an attorney with a caseload of many), zealous defense (determining the limits of what should be done to defend clients), and confidentiality (keeping clients’ confidences even if it harms third parties).
